TERMS OF SALE AND CONTRACT

All of our Pomeranians are AKC registered only. We (Seller) reserve the right to revoke any sale of our puppies, at any time during the process, with total refund. We (Seller) also will exercise the right to use limited registration when we feel a certain puppy will not benefit the breed to be bred. Limited registration means only that any progeny produced by the dog/bitch will not be registered through the AKC. This is to preserve the future integrity of the breed, and does not indicate that your pup will not make a good pet. Proof of spay/neuter will be required to receive the AKC registration papers.
Note: It is understood and agreed that a non-refundable deposit of $200 is due upon acceptance of this agreement, in order to hold this puppy until it reaches an age of 6-12 weeks. The remaining balance must be paid in full at the 6-12 week point by a United States Postal Money Order, or other pre-approved payment method, or chance of ownership will be forfeited. If the puppy is already 6-12 weeks of age, then full payment must be sent in unless other arrangements have been agreed upon. Other forms of payment accepted are cash, Wal-Mart Moneygram or Money Order, Paypal (with 3% added for fees, possible hold time, and only from USA, Canada & UK), and personal checks under certain circumstances. If death or injury of the puppy happens before the puppy has been picked up by Buyer, the Buyer will have the option of choosing another puppy from that same litter, pick of similar litter, or a refunded deposit.
City Poms sells directly to buyers only. Any buyer must disclose if they are a puppy/dog broker. "Puppy Broker" being defined as anyone who purchases a puppy/dog with the explicit intention to turn around and sell the puppy/dog to another buyer within a 3 month time span. If it is found by the seller that a potential buyer is in fact a puppy broker, then all monies deposited to the seller will be forfeited. It is then up to the seller's discretion whether the puppy will be sold and relinquished to the buyer. We, City Poms, do purchase puppies/dogs with the intent to keep them as family pets and breeders. If the puppy/dog does not turn out to be of breeding quality, we will sell the puppy as pet quality without papers, in which case the broker clause does not apply. We do not intentionally buy puppies/dogs to turn around and make a quick profit. All of our dogs are well cared for and treated as a loving member of the family. We expect all of our puppies sold to be treated in the same manner. We do not sell to puppy mills or large backyard breeders who will put our babies in cages. The pups/dogs we raise are under foot and never kept in cages. We insist they be kept to the same standards when they arrive at their new home. The only exception would be for kenneling training indoors. If it is proven that the puppy/dog has in fact remained in a kennel or unclean living facility, the puppy/dog will be immediately returned to the sellers at the buyer’s expense, forfeiting any monies paid to the seller on the puppy/dog. We are merely looking out for the health and well-being of our beloved babies.
ENTIRE AGREEMENT This agreement is the complete agreement between Seller and Buyer and no promises or guarantees are made unless contained herein in writing. Any changes or additions to this agreement must be in writing and signed by Seller and Buyer. If you have purchased over the Internet, this contract is in effect automatically. The only warranties given are those expressly set out herein. All puppies/dogs must be paid in full before pickup or shipping. City Poms, the Seller, also cannot guarantee adult size and weight - NO BREEDER CAN. Overfeeding can make them overweight as they grow. We, as a responsible Seller, will try to estimate adult weight as best we can. We can only give you an educated guess, based on parents’ weight and puppy growth charts. We cannot guarantee a puppy personality will not change; a puppy’s personality is based on their environment. We recommend training/behavior classes for all puppies. With a clean bill of health when they leave here, we cannot guarantee against coccidia, parasites, or hypoglycemia, as they are preventable and we use precaution for them here. You, as the Buyer and new owner, must take full responsibility to protect your new puppy. Registration papers and health certificate will be attached to the top of the puppy’s crate when flown. Failure of Buyer to contact Seller within 6 hours of flight pick-up will void any and all contractual obligations by us to you. You MUST contact us upon pick-up. HEALTH GUARANTEE All puppies will receive immunizations and worming according to their age, and are sold to be free of communicable disease as far as appears to the eye. A 72 hour warranty exists against distemper, parainfluenza, adenovirus 2 plus, and parvovirus on a puppy sold, and possibly leptospirosis & corona if the pup is older. In the event that a death occurs from one of these diseases or that treatment is required, a report from a veterinarian will be required to apply for the warranty of a replacement puppy. Shipping and health certificate expense incurred in returning a puppy and for replacement puppy of equal value will be at the Buyer’s expense. Replacement is the only remedy offered. GENETIC GUARANTEE A guarantee exists on genetic defects of heart, lungs, kidney, and liver. In the event that one of these genetic defects is discovered, a report will be required from a veterinarian within 1 year of purchase date, and immediately upon finding out. Please let us know immediately if a genetic defect has occurred in your animal. As thorough as a genetic screening can be, it is sometimes only detectable through offspring and it is of the utmost importance that genetic predispositions to a specific defect be caught as early as possible to prevent future catastrophes. In the event that a genetic defect as listed above is discovered, the Buyer may return the animal for a replacement of equal value. Shipping and health certificate expense incurred in returning the animal and for replacement puppy will be at the Buyer’s expense, within the 1 year of purchase period. Regarding testicular descension in males sold for breeding or show purposes: the only recourse we can offer is a replacement male of equal breeding/show quality. The male pup will need to be returned to us as described in the warranty section above, and a replacement male will be provided in the same way. We (the Seller) will not breed males with only one testicle, but realize it can occur unbeknownst to us through the dam’s side or fluke of nature. Collapsing trachea and patellar luxation are not covered under warranty as knowledge of, and development of, such conditions may not occur until adulthood, and are sorely dependent upon their care and environment. Use of halter collars is mandatory with these small breeds, as well as restricting rawhide and similar consumption, to protect against the development of tracheal problems. The same goes with the use of steps and other aides with these small breeds, as well as proper supervision, to prevent injury to their knees by jumping or falling. Strict supervision around children, and prevention of being stepped on goes without saying: they are a small and fragile breed remember. We (Seller) will give you our promise, however, to be highly selective in the breeders we purchase and use in producing our puppies for sale. We (Seller) will have them thoroughly examined by our veterinarian for any faults before selectively breeding them. Should they be found to have or develop such faults, we will not breed, or will discontinue breeding them upon discovery. Each pup will also be evaluated for tracheal or patella problems before leaving us, and any finding reported to the buyer. No other warranty exists between the Buyer and Seller of the puppy/dog. Veterinary expenses are the sole responsibility of the Buyer. Buyer is also responsible for the costs associated with the veterinarian check/health certificate, shipping crate, and shipping costs. A veterinary certificate of health is required within 72 hours of receipt of a purchased puppy/dog. The certificate must be mailed to the seller to initiate the health guarantee on the puppy/dog. Failure to have your puppy/dog checked out by a veterinarian within 72 hours, and the results mailed to Seller, will result in negation of the contract. When purchasing over the Internet, this contract is automatically in effect. The sole jurisdiction and venue for any suit filed by Seller or Buyer in any way connected with this agreement shall be in Shelby County, Tennessee. The prevailing party in any litigation shall be entitled to their reasonable costs and attorney’s fees.
